How many Judges are there in the Commercial Court?

I have my first directions hearing in the Commercial Court coming up, what can I expect?

It is worth reading the Notices to the Profession regarding the flexible and expeditious nature of the Commercial Court hearings.

Is there a pro-forma for initial directions?

There is no set pro-forma for initial directions orders. Parties are asked to discuss and hopefully agree upon a timetable for consideration by the List Judge. The “Green Book” has a guide as to what type of matters should be considered in initial directions.

Further questions regarding the particular requirements of the List Judge managing your matter may be directed to the Associate to that Judge.

Will I be sent orders today?

Orders are usually typed and authenticated within one week of the hearing or soon thereafter. The orders are sent out to all parties immediately upon authentication.

Which list will I be in and to whom do I send correspondence?

The list within the Commercial Court will be allocated by the Registrar at the time of issuing your originating documents. Any matter filed under a provision of the Corporations Act will ordinarily be allocated into List E

Which list do I write on my documents?

Once you have been allocated into a list within the Commercial Court then all subsequent documents should state that list clearly in the upper right hand corner of the first page. Prior to issuing proceedings the List should be left blank and registry officers will write in the correct list upon issuing.

I want to appeal a decision of an Associate Judge in the Corporations list. What do I file and before whom shall I make it returnable?

All appeals of decisions are returnable before the Judge in charge of the allocated List on the next available directions day (Fridays). Contact the Registrar to determine the best return date or to discuss details of forms and timelines.

The Commercial Court supports the same technology that is available to all matters before the Supreme Court.

What type of case can be entered into the Commercial Court?

Generally, any commercial proceeding or corporations case may be entered in the Commercial Court.
