Discovery in Australia is increasingly becoming  unmanageable. The new Chief Justice of the Federal Court of Australia, the Honourable Patrick Kean, recently suggested that discovery might be reduced to the dozen most important documents.  Dr Wolfgang Babeck and commentators Judge Judith Gibson and Frédéric Venière will explore discovery in the context of the civil law system with reference to civil law countries in which discovery is the exception rather than the rule.
